Terms of Service

These Terms of Service (“Terms”) are an agreement between you (“you”) and HeyLang (“HeyLang,” “we,” “us”), an SMBA system, governing your use of our websites, dashboard, and services (the “Service”). By creating an account or using the Service, you agree to these Terms. If you use the Service on behalf of a business, you represent that you are authorized to bind that business.

The Service

HeyLang provides AI-powered marketing services — “Ghost Marketing” — that plan, create, and, with your permission, publish marketing content under your name across your connected accounts. Features and plans may change over time.

Accounts & eligibility

You must provide accurate information and keep your login credentials secure. You are responsible for all activity under your account. You must be at least 16 years old and capable of forming a binding contract.

Subscriptions, billing & cancellation

• Paid plans are billed in advance on a recurring basis (monthly or annual) through our payment processor, Stripe.
• Subscriptions renew automatically until cancelled. You can cancel at any time from your account; cancellation takes effect at the end of the current billing period.
• Except where required by law, payments are non-refundable. Prices may change on renewal with prior notice.

Your content & ownership

You retain ownership of the information you provide and of the marketing content produced for your business. You grant HeyLang a limited license to use, process, store, and transmit that content solely to operate the Service and perform the actions you request — including publishing to the accounts and platforms you connect.

Connected accounts & authorization

When you connect a third-party account (such as Google, Meta, LinkedIn, X, or your website/CMS), you authorize HeyLang to access that account and act within the scope you approve — for example, to read analytics or publish content. You are responsible for maintaining the rights and permissions needed for those accounts, and you can disconnect them at any time. Your use of third-party services is also subject to their terms.

AI-generated content

The Service uses AI to generate content and recommendations, which may occasionally be inaccurate or incomplete. You control how much the Service does on its own through the available control modes (from full autopilot to approve-everything). You are responsible for reviewing and approving anything published under your accounts, and for ensuring it complies with applicable laws and platform rules.

Acceptable use

You agree not to use the Service to:

• break the law or infringe others' rights;
• publish deceptive, unlawful, or harmful content;
• send spam or violate the rules of connected platforms;
• attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service; or
• resell or provide the Service to third parties except as expressly permitted.

Our intellectual property

The Service, including its software, models, design, and brand, is owned by HeyLang and its licensors and is protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service — not to own it. A HeyLang subscription is a right to use the Service, not a purchase of the Service itself.

Disclaimers

The Service is provided “as is” and “as available.” We do not guarantee specific results, rankings, traffic, or revenue. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the fullest extent permitted by law, HeyLang will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve months before the claim.

Indemnification

You agree to indemnify and hold HeyLang harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or the rights of others.

Termination

You may stop using the Service and cancel at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm. Content already published to your own platforms remains yours.

Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected in the date above and, where appropriate, communicated to you. Continued use of the Service means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the United States and the state in which HeyLang is established, without regard to conflict-of-laws rules. Disputes will be resolved in the courts located there, unless applicable law requires otherwise.
